My NHS trust has introduced a new policy that stops pay progression if you are off sick. Can it do this?
The CSP, along with four other health unions, recently took Central Manchester NHS Foundation Trust to an employment tribunal after it imposed rules on employees who were sick on four or more occasions in a year.
They would lose that year’s pay increment as a result, the trust said.
The tribunal found that the trust had no right to withhold increments as a result of sickness absence under the Agenda for Change terms and conditions.
This ruling means that NHS trusts that impose similar policies should be challenged. Visit the CSP website for further details at: www.csp.org.uk or speak to your CSP workplace steward.
