Terms and conditions

Terms and conditions of Chartered Society of Physiotherapy ("CSP") for use of certain data in the CSP Database of Researchers.

You have requested to receive a CSP Excel spreadsheet ("the Excel Contacts Spreadsheet") containing contact details of researchers taken from the CSP Database of Researchers (where the researchers have given their consent).

Subject to CSP’s verification that you are eligible (as specified in paragraph (a) (i), (ii), (iii), (iv) or (v) below) to use the Excel Contacts Spreadsheet, CSP grants you the non-exclusive, non-transferable licence for the period of three months from the date of your acceptance of these terms and conditions: (a) to use the data contained in that Spreadsheet solely for the purposes of:
  1. you (being an individual contracted to work in a research capacity on CSP’s behalf) facilitating research and for communicating directly with any researcher named in the Excel Contacts Spreadsheet; or
  2. you (being involved in the National Physiotherapy Research Network) facilitating research and for communicating directly with any researcher named in the Excel Contacts Spreadsheet; or
  3. you (being a CSP member) facilitating research and for communicating directly with any researcher named in the Excel Contacts Spreadsheet; or
  4. you (being a non-commercial third party with which the CSP works collaboratively) facilitating research and for communicating directly with any researcher named in the Excel Contacts Spreadsheet; or
  5. you (being a commercial third party identified by the CSP as a provider of services that may be of benefit) providing information on your products and services to any researcher named in the Excel Contacts Spreadsheet.
and subject to the following terms and conditions:
  1. "Excel Spreadsheet" shall mean the Excel Contacts Spreadsheet of which you have requested to receive a copy. "Data" shall mean the data contained in the Excel Spreadsheet.
  2. You must not use the Excel Contacts Spreadsheet or Data therein for any other purpose and must not assign or sub-license any of your rights granted by those terms and conditions.
  3. CSP will email to you at the address you have provided for this purpose the Excel Spreadsheet normally within ten working days ("working days" exclude Saturday, Sunday or a bank holiday) of your acceptance of these terms and conditions.
  4. CSP owns the copyright and database rights in the Excel Spreadsheet and Data and you will not acquire any rights in that copyright or database rights except as expressly licensed in these terms and conditions.
  5. You must not sell, rent, disclose or otherwise make available, whether for a charge or free, any part of the Excel Spreadsheet to a third party.
  6. Where the Data is integrated with any computer system or information source, you must ensure that all parts of the Data are clearly identifiable, in order to ensure that you are able to remove the Data from your system on termination of this licence.
  7. CSP is not obliged to provide any updates of the Excel Spreadsheet.
  8. You must comply with the Data Protection Act 1998 (as modified or re-enacted) in respect of the Data transferred to you.
  9. CSP makes no warranties or representations about the accuracy or completeness of the Data. You are responsible for ensuring you have Excel or other software to enable you to open the Excel Spreadsheet. CSP does not accept any liability for loss arising from your inability to use the Excel Spreadsheet. These provisions do not apply to CSP’s liability for death or personal injury arising from CSP’s negligence.
  10. CSP may terminate this licence immediately by written notice to you if you commit a material breach of these terms and conditions and (if capable of remedy) you fail to remedy such breach within 14 days after written notice has been given requiring its remedy.
  11. On termination or expiry of this licence you must immediately cease to use the Data and Excel Spreadsheet and delete and destroy all copies of the Excel Spreadsheet which are then in your possession or under your control.
  12. Any notice under this letter must be in writing and be sent by recorded delivery first class post to you at your CSP membership registered address. Notice will be treated as having been served two days after posting.
  13. A person who is not a party to these terms and conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 (as modified or re-enacted) to enforce any of these terms and conditions.
  14. These terms and conditions shall be governed by English law.
  15. You must confirm by email to the CSP by completing a Request for a Search of the CSP Database of Researchers Form, that you agree these terms and conditions and to be bound by them.
